D. 1944 AND IN THE YEAR OF THE INDEPENDENCE OF THE UNITED STATES OF AMERICA, THE ONE HUNDRED AND SIXTY-EIGHTH VOLUME XLV Printed by Milford Chronicle Publishing Company Milford, Delaware LAWS OF DELAWARE State Revenue and Supplies CHAPTER 1 INCOME TAX AN ACT TO EXEMPT FROM INCOME AND GROSS INCOME TAX THE COMPENSATION OF PERSONS IN THE ARM-ED FORCES OF THE UNITED STATES OR THE MER-CHANT MARINE OF THE UNITED STATES OR SERV-ING IN THE AMERICAN RED CROSS, THE SOCIETY OF FRIENDS, THE WOMEN AIR FORCE SERVICE PILOTS OR THE UNITED SERVICE ORGANIZATIONS AND ATTACHED TO AND SERVING WITH THE ARMED FORCES OF THE UNITED STATES UP TO THE FIRST THREE THOUSAND DOLLARS ($3,000.00) IN CERTAIN TAXABLE YEARS. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: Section 1. That for the purpose of taxation in respect of the income tax or war emergency tax on gross incomes the com-pensation of a taxable received for service in the Armed Forces of the United States, including mustering-out pay, or for service in The Merchant Marine of the United States, or for serving in The American Red Cross, The Society of Friends, The Women Air Force Service Pilots or the United Service Organizations attached to and serving with the Armed Forces of the United States, up to the first Three Thousand Dollars ($3,000.00) of the amount of such compensation, including mustering-out pay, shall be exempt from the provisions of Article 12, Chapter 6, Revised Code of Delaware 1935, as amended, relating to the income tax and from the provisions of Article 26, Chapter 6, Revised Code of Delaware 1935, as amended, relating to the war emergency tax on gross incomes, being Chapter 7, Volume 44, Laws of Delaware 1943. 3 Approved March 24, 1944. INCOME TAX Chapter 1 Section 2. The provisions of this act shall be effective for each of the taxable calendar years 1942, 1943 and 1944 and for each taxable calendar year thereafter for the duration of the war and the State Tax Department is hereby directed to refund any tax paid upon the income of any taxable for each of the taxable years 1942, 1943 and 1944 to the extent to which said tax or taxes have been paid upon compensation, including mus-tering- out pay, as hereinbef ore exempted upon receipt of a claim properly executed by a taxable evidencing over-payment of tax. Section 3. All acts or parts of acts inconsistent with the provisions of this Act are hereby repealed to the extent of such inconsistency only. Elections CHAPTER 2 RELATING TO REGISTRATION OF VOTERS AN ACT TO AMEND CHAPTER 56 OF THE REVISED CODE OF DELAWARE 1935, AS AMENDED, RELATING TO REGISTRATION OF VOTERS. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: Section 1. That Chapter 56 of the Revised Code of Dela-ware 1935, as amended by Chapter 110, Volume 44, Laws of Delaware, be and the same is hereby further amended by striking out and repealing all of the first paragraph of 1712. Sec. 7. there-of and by enacting and inserting in lieu thereof the following: In those years in which a supplementary registration is had, as provided for in this Chapter, it shall be the duty of the Registrar and two Assistant Registrars appointed in each elec-tion district in this State to register the names of all qualified voters in each such election district, whose names do not appear as qualified voters on the books of registered voters, and to that end they shall sit for the purpose of ascertaining and registering the persons who are qualified to enjoy the right of an elector and who shall apply in person for registration, and whose names do not already appear as qualified voters on the books of registered voters, at such public and suitable places in their respective elec-tion districts as will, in the judgment of the Board of Registra-tion of the respective registration department districts in this State, be the most convenient for the voters thereof, from eight o'clock a. m. until seven o'clock p. m., with an intermission from twelve to one o'clock, on the second Wednesday in July and on the third Saturday next preceding the day of election. 5 6 Chapter 2 RELATING TO REGISTRATION OF VOTERS Section 2. That wherever in the laws of this State, per-taining to the registration of voters, the phrases "second Thurs-day in August" or "the registration day in the month of August", or "the last registration day in August" are used in connection with registration of voters, the same are hereby repealed and stricken out and the phrase "second Wednesday in July" is here-by enacted and inserted in lieu thereof. Section 3. That Chapter 56 of the Revised Code of Dela-ware 1935, as amended, be and the same is hereby further amend-ed by striking out and repealing all of the last paragraph of 1727. Sec. 22. thereof and by enacting and inserting in lieu there-of the following: It shall be the duty of the Board of Registration of each Registration Department District, prior to the second Wednes-day in July in the year in which a general election is to be held, to deliver the two "Registers" and the two "Books of Registered Voters" of each election district in its Registration Department District, to the Registrar of said election district; provided, that in any year in which there is a special election, the registration books for the election districts in which the special election is to be held, shall be delivered by the Board of Registration of the Registration Department District in which the said special elec-tion is to be held, to the proper Registrars. Within three days after the registration day on the second Wednesday in July on which a supplementary registration is held, the Registrar of each election district shall return and de-liver to said Boards of Registration respectively said two Regis-ters and said two Books of Registered Voters for use by said Boards of Registration, which Boards shall retain the custody thereof until said Boards shall deliver said books to the Regis-trars of each election district respectively prior to the registra-tion day on the third Saturday next preceding the day of election ; thereafter said books shall be retained by each Registrar until delivered and disposed of as hereinbefore provided. Section 4. That Chapter 56 of the Revised Code of Dela-ware 1935, as amended, be and the same is hereby further amend- Chapter 2 7 RELATING TO REGISTRATION OF VOTERS ed by enacting and adding a new paragraph thereto immediately following 1733. Sec. 28., to be known as 1733. A. Sec. 28 A., as follows : 1733. A. Sec. 28 A. In addition to the registration days as in this Chapter provided and commencing on the first day of April, A. D. 1944 and continuing each day thereafter, Sundays and legal holidays excepted, the Board of Registration for the respective Registration Department Districts in this State shall sit between the hours of 9:00 A. M. and 5 :00 P. M. in the office of the Department for the purpose of registering every qualified elector who is a member of the armed forces, or of the Merchant Marine of the United States, or is serving with the American Red Cross, the Society of Friends, the Women Air Force Service Pilots, or the United Service Organizations attached to the armed forces of the United States, or who has received official notice of induction or acceptance into any of such services, whose name does not already appear as a registered voter on the registration books for his or her election district and who shall appear in person at the office of the said Board of Registration of the Regis-tration Department District of which said person is a resident, or for the purpose of transferring the registration of any such elector; provided however, no such person shall apply for regis-tration or transfer of registration within the period commencing ten days prior to the day of election and ending ten days there-after. For the purposes of this Chapter the members of the Board of Registration for the respective Registration Department Dis-tricts are authorized and empowered to perform all the duties required of registration officers as in this Chapter provided ; the Board of Registration for the respective Registration Department Districts may also appoint not more than two capable persons as Auxiliary Registration officers who shall be residents and voters in the County for which they are appointed, the Auxiliary Regis-tration officers so appointed shall possess all the powers and perform all the duties imposed by law upon registration officers, except that they shall not be nor shall they be authorized to perform any of the duties of an election officer. Chapter 2 RELATING TO REGISTRATION OF VOTERS Auxiliary Registration officers appointed under the provis-ions of this Section shall be equally divided between the two principal political parties, and they shall serve at the pleasure of the Board of Registration making such appointments. .Before eptering upon their duties as registration officers, the members of the Boards of Registration for the respective Registration Department Districts and the Auxiliary Registra-tion officers shall take and subscribe to the oath or affirmation as prescribed in this Chapter for other registration officers. If any vacancy or vacancies should occur among the Auxiliary Registration officers for any cause, the Board of Registration in which Registration Department District such vacancy or Vacan-cies shall occur shall appoint some capable person or persons to fill such vacancy or vacancies and who shall possess the same qualifications and be qualified in the same manner, possess the same powers and perform the same duties as the original ap-pointee or appointees. Section 5. That Chapter 56 of the Revised Code of Dela-ware 1935, as amended, be and the same is hereby further amend-ed by striking out and repealing all of the second paragraph of 1706. E. Sec. 1 E. thereof and by enacting and inserting in lieu thereof the following: When the boundaries of any election district shall be chang-ed, either as hereinabove provided or by an Act of the General Assembly, the Board of Registration of the Registration Depart-ment District of the County in which such election districts are located, not later than the thirtieth day of June of the year in which such change shall be made, shall procure and prepare the Registers, Books of Registered Voters, and Voting Books of Qualified Voters for Primary Elections, as provided for by law for each election district, and for every election district affected or created by such change of boundaries shall transfer by trans-cribing in said books for each such election district the names and other particulars, as required by law, of every registered voter respectively residing in each election district affected or Chapter 2 9 RELATING TO REGISTRATION OF VOTERS created by the change of boundaries, omitting therefrom all names which theretofore have been stricken from the list of registered voters. Any voter, whose name appears in said books as a duly registered voter of the election district before said change, shall not be required to re-register because of the change in election districts arising from said change of boundaries, but' it shall be the duty of the proper Board of Registration to cause the name and particulars of every registered voter to be transferred to the proper books for such election districts, henceforth to be used for the election district of which the registered voter is then a resident. Upon said transfer being completed, each of said books shall be compared as to their correctness and shall be verified in the same manner as now provided for by law relative to duplicate registration books and Voting Books of Qualified Voters for Primary Elections, as set forth in 1717. Sec. 12. and 1776. Sec. 8. of the Revised Code of 1935, as amended, but said books shall be known as original books and shall not be endorsed as Duplicate Books. The said Board of Registration shall keep and preserve until the last day of February next after the ensuing general election all the books from which said transfers have been made. Section 6. All acts or parts of acts inconsistent herewith are hereby repealed in so far as such inconsistency exists. Approved March 24, 1944. 10 CHAPTER 3 PRIMARY ELECTIONS TIME FOR HOLDING AN ACT TO AMEND CHAPTER 58 OF THE REVISED CODE OF DELAWARE 1935, RELATING TO PRIMARY ELECTIONS. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: SECTION 1. That Chapter 58 of the Revised Code of Dela-ware 1935, be and the same is hereby amended by striking out and repealing all of the first paragraph of 1780. Sec. 12. thereof and by enacting and inserting in lieu thereof the following: The time for holding any primary election, except primary elections to nominate candidates for municipal elections, shall be not later than on the last Saturday in August in the year in which such primary election is held, and the time for holding pri-mary elections in the City of Wilmington to nominate candidates to be voted for at a municipal election shall be in the month of May. SECTION 2. That wherever in the primary election laws of this State, reference is made to the phrase "second Thursday in August", or to the phrase "the registration day in the month of August", or to the phrase "the last registration day in August", said phrases are hereby repealed and stricken out and the phrase "second Wednesday in July" is hereby enacted and inserted in lieu thereof. Approved March 24, 1944. CHAPTER 4 GENERAL ELECTIONS CERTIFICATES OF NOMINATIONS; BALLOTS AN ACT TO AMEND CHAPTER 60 OF THE REVISED CODE OF DELAWARE 1935, AS AMENDED, RELATING TO GENERAL ELECTIONS. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: SECTION 1. That Chapter 60 of the Revised Code of Dela-ware 1935, as amended, be and the same is hereby further amend-ed by striking out and repealing all of paragraph 1812. Sec. 3. thereof and by enacting and inserting in lieu thereof the follow-ing: Certificates of nominations herein directed to be filed with the Secretary of State, or the Clerks of the Peace, as the case may be, shall be filed before six o'clock P. M. (Eastern Standard Time) on or before the first day of September of the year of any general election, and if said first day of September is a Sunday or a legal holiday, then on the next day ; and if said next day shall be a holiday, then on the succeeding day. The Secretary of State, and the Clerks of the Peace, shall cause to be preserved in their respective offices all certificates of nomination filed under the provisions of this Chapter for six months after the date of filing thereof. SECTION 2. That Chapter 60 of the Revised Code of Dela-ware 1935, as amended, be and the same is hereby further amend-ed by striking out and repealing all of the first and second para-graphs of 1817. Sec. 8. thereof and by enacting and inserting in lieu thereof the following: The Clerk of the Peace in each County shall cause to be printed, within the State of Delaware, in the forms hereinbefore provided, five ballots of each official ballot for every voter in each Election District in his County ; the number of voters shall be ascertained in each Election District by reference to the highest 11 12 Chapter 4 GENERAL ELECTIONS CERTIFICATES OF NOMINATIONS; BALLOTS number of votes polled therein at any preceding election, with due allowance for any estimated increase thereof. If a new Elec-tion District has been established in his County, the number shall be estimated by said Clerk of the Peace according to the best information he can obtain. It shall be the duty of the Clerk of the Peace in each County, in addition to the above mentioned ballots, to have printed and available for use and distribution, the ballots, envelopes and in-structions to absentee voters, authorized by the provisions of the absentee voting law or laws of this State, as soon as possible after the final date of the filing of nominations but in any event forty-five days prior to the date of the ensuing general election. The quantity thereof shall not exceed two times the estimated number of absentee voters eligible to vote at the ensuing general election, as shall be estimated by said Clerk of the Peace accord-ing to the best information he can obtain. The Clerk of the Peace in each County, in addition to the above mentioned ballots, shall cause to be printed such further number of ballots as shall be directed by the Chairman of Any committee of any political party, in any county, provided, how-ever, that the said Clerk of the Peace shall not have printed any ballots upon the order or request of any Chairman of any politi-cal party unless the said request shall have been made to him in writing at least sixty-five days prior to the holding of the election at which the said ballots are to be used, nor unless a deposit sufficient to cover the cost of the ballots be made at the time they are ordered. The ballots so ordered by the said Chair-men of the various political parties shall be delivered to the said Chairmen or to their agents upon their request or order not more than ten days and not less than five days before the election at which the said ballots are to be used. SECTION 3. That Chapter 60 of the Revised Code of Dela-ware 1935, as amended, be and the same is hereby further amend-ed by striking out and repealing the fourth paragraph of 1814. Sec. 5. thereof and also all of the fifth paragraph of 1814. Sec. 5. Chapter 4 13 GENERAL ELECTIONS CERTIFICATES OF NOMINATIONS; BALLOTS thereof immediately preceding the ruled portion of the plan for the Presidential and Vice-Presidential Ballot, and by enacting and inserting in lieu thereof the following: The Clerk of the Peace in each County shall cause the cor-rect Representative District number to be plainly printed on the margin at the top of the official State, County and District Ballots, but not on the Official Presidential and Vice-Presidential Ballots, as nearly as possible in the following form : "OFFICIAL BALLOT FOR REPRESENTATIVE DISTRICT NUMBER PI The Clerk of the Peace in each County shall cause the words "Official Presidential and Vice-Presidential Ballot" to be plainly printed on the margin at the top of the "Presidential and Vice-presidential Ballot", and without any number of a Representative District, and immediately under the words "Official Presidential and Vice-Presidential Ballot", the Clerk of the Peace in each County shall cause the words "A Vote for the Candidates for President and Vice-President shall be a Vote for the Electors of such Party, the Names of whom are on file with the Secretary of State" to be plainly printed on the said "Official Presidential and Vice-Presidential Ballot". The "Official Presidential and Vice- Presidential Ballot" shall in general conform, as nearly as poss-ible, to the following plan : OFFICIAL PRESIDENTIAL AND VICE-PRESIDENTIAL BALLOT A vote for the candidates for President and Vice- President shall be a vote for the electors of such party, the names of whom are on file with the Secretary of State. (Followed by ruled plan set forth in Chapter 119 Volume 44 Laws of Delaware, page 407). Approved March 24, 1944. 14 CHAPTER 5 GENERAL ELECTIONS ABSENTEE VOTING AN ACT TO AMEND CHAPTER 118 OF VOLUME 44, LAWS OF DELAWARE, ENTITLED "AN ACT TO PERMIT VOTING BY PERSONS NOT PRESENT AT THE POLLING PLACES, UNDER CERTAIN CIRCUMSTANCES AND CONDITIONS". Be it enacted by the Senate and House of Representatives and striking out all of Section 4 thereof and by enacting and nor less than three days prior to a general election and within of Delaware, be and the same is hereby amended by repealing istered elector, the said Clerk of the Peace, not more than sixty inserting in lieu thereof the following : and if such request shall be made to any other official of this State, it shall be immediately transmitted to the Clerk of the Peace of the county in which the election district of such elector is located, and the Clerk of the Peace of that county shall act upon such as a request made directly to him. That Section 2 of Chapter 118 of Volume 44, GENERAL ELECTIONS ABSENTEE VOTING three days after the ballots, envelopes and instructions to ab-sentee voters become available, as provided by the General Elec-tion Law, as amended, shall mail to the elector, postage prepaid, an official ballot for the proper representative district in which the said elector is a resident and in which he is duly registered, or such officer shall deliver such a ballot to the elector personally, not more than thirty nor less than one secular day before said election, accompanied by a voucher envelope, a carrier envelope self-addressed to said Clerk of the Peace and a copy of "Instruc-tions to Absentee Voter", as hereinafter provided. Section 3. That immediately after Section 19 thereof there shall be enacted and added a new paragraph to be known as Sec-tion 19. A. thereof, as follows : Section 19. A. Any affidavit required under the provisions of this Chapter, when made by an elector in the armed forces or Merchant Marine of the United States, or by persons serving with the American Red Cross, the Society of Friends, the Women Air Force Service Pilots, and the United Service Organizations who are attached to and serving with the armed forces of the United States, may be taken before any commissioned or non-commissioned officer not below the rank of sergeant, or petty officer, in the armed forces of the United States, or any member of the Merchant Marine of the United States properly designated for such purpose, or any other person authorized to administer and attest oaths or affirmations, and whenever taken outside the State of Delaware, the authority of such person shall be con-clusively presumed. Section 4. That Chapter 118 of 44 Laws of Delaware be and the same is hereby amended and supplemented by enacting and adding thereto immediately after Section 22 thereof two new sections to be known as Sections 23 and 24 thereof, as follows : Section 23. In order to expedite and afford the opportunity to cast a vote for all candidates in nomination at the ensuing. general election by such qualified and registered voters tempor- Chapter 5 15 16 Chapter 5 GENERAL ELECTIONS ABSENTEE VOTING arily outside the territorial limits of the several States of the United States and the District of Columbia, and who are mem-bers of the armed forces or of the Merchant Marine of the United States, or persons serving with the American Red Cross, the Society of Friends, the Women Air Force Service Pilots and the United Service Organizations attached to and serving with the armed forces of the United States, if, on or before the first day of September in the year of a general election, in the joint judg-ment of the Governor, Secretary of State and the Attorney Gen-eral of this State, it is deemed expedient to make certain changes in the size, weight or material of the ballots, envelopes, instruc-tions to absentee voters, form of request for ballot, form of affi-davit of elector, the address or any other direction or printing or endorsement upon the voucher or carrier envelopes, postage or manner of transmission, then such officers jointly are hereby authorized and directed to make and cause to be made effective any or all such changes to the end that there shall be extended to any such elector full opportunity to receive and return a marked ballot to the poll of his residence on election day to be acted upon and counted as other votes personally cast at such poll ; provided, however, that the plan and arrangement of any official ballot and the list of candidates thereon, as provided for by the General Election Law, shall not be changed or altered under any circum-stances. Upon the making of any such changes, by the said Gover-nor, Secretary of State and the Attorney General, they shall jointly in writing forthwith notify the Clerk of the Peace of each county of such changes, and each such Clerk of the Peace shall cause such changes to be carried into effect, and the ballots, en-velopes and instructions, as so changed, to be so printed, trans-mitted and distributed. Such changes shall be uniform for absentee voting through-out the State, but shall apply only to absentee voting by such electors as specified in the first paragraph of this Section who are outside of the territorial limits of the several States of the United States and the District of Columbia ; otherwise and for Chapter 5 17 GENERAL ELECTIONS ABSENTEE VOTING absentee voting by electors within the territorial limits of the said several States and the District of Columbia, the provisions of Sections 1 to 21 inclusive of this Chapter only shall apply. Section 24. If any request for an absentee ballot and ac-companying envelopes or any marked ballot of any such elector shall be addressed to and returned to the Secretary of State of this State, or to.any official other than the Clerk of the Peace of the county of residence of the absentee elector, then said Secre-tary of State, or other official, shall immediately transmit such request or returned marked ballot to the Clerk of the Peace of the county of residence of such elector, to be acted upon by said Clerk of the Peace as provided by this Chapter. Approved March 24, 1944. Additional Boards, Commissions and Other Chapters CHAPTER 6 STATE BOARD FOR VOCATIONAL EDUCATION AN ACT TO AMEND CHAPTER 201, 42 LAWS OF DELA-WARE, ENTITLED "AN ACT TO PROVIDE FOR THE VOCATIONAL REHABILITATION AND PLACEMENT OF PHYSICALLY DISABLED PERSONS, AND TO MAKE APPROPRIATIONS FOR THE SAME", BY REDEFINING THE TERM "DISABLED PERSON" AND INCREASING THE SCOPE OF SAID ACT. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: Section 1. That Chapter 201, Volume 42, Laws of Dela-ware, be and the same is hereby amended by striking out all of Section 1 thereof and by enacting and inserting in lieu thereof the following: Section 1. That in order to provide for the vocational re-habilitation of disabled persons, there is hereby established, under the direction and control of the State Board for Vocational Education, a division for the vocational rehabilitation and place-ment in remunerative employment of persons whose capacity to earn a living is or has been destroyed or impaired. Section 2. That Chapter 201, Volume 42, Laws of Dela-ware, be and the same is hereby amended by striking out all of Section 2 thereof and by enacting and inserting in lieu thereof the following: Section 2. That for the purposes of this Act the term "dis-abled person" means any person who, by reason of a defect or infirmity, whether congenital or acquired by accident, injury, or 18 Chapter 6 19 STATE BOARD FOR VOCATIONAL EDUCATION disease, is, or may be expected to be, totally or partially incapaci-tated for remunerative occupation ; the term "vocational rehabil-itation" means the rendering of a disabled person fit to engage in a remunerative occupation. To be eligible for rehabilitation a person must possess an employment disability. and must be susceptible of rehabilitation. Section 3. That Chapter 201, Volume 42, Laws of Delaware, be and the same is hereby amended by striking out all of Section 6 thereof and by enacting and inserting in lieu thereof the fol-lowing: Section 6. The State of laware hereby accepts the pro-visions and benefits of the Act of Congress entitled "An Act to Provide for the Promotion of Vocational Rehabilitation of Per-sons Disabled in Industry or Otherwise and Their Return to Civil Employment", approved June 2, 1920, as amended ; and desig-nates the State Treasurer as custodian of all moneys received by the State from appropriations made by the Congress of the United States for vocational rehabilitation of persons disabled in in-dustry or otherwise,and authorizes the State Treasurer to make disbursements therefrom upon the order of the State Board for Vocational Education ; and empowers and directs the State Board for Vocational Education to cooperate with the Office of United States Vocational Rehabilitation, Federal Security Agency, or other Federal agency authorized by Congress, in carrying out the provisions of the national Vocational Rehabilitation Act and amendments thereto. Section 4. This Act shall become effective immediately upon the approval thereof. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met (two-thirds of all the members elected to each House thereof agreeing thereto): Section 1. That Section 25 of Article 2 of the Constitution of the State of Delaware, be and the same is hereby amended by striking out said section and inserting in lieu thereof a new sec-tion to be known as Section 25, as follows Section 25. The General Assembly may enact laws under which municipalities and counties may adopt zoning ordinances, laws or rules limiting and restricting to specified districts and regulating therein buildings and structures according to their construction and the nature and extent of their use, as well as the use to be made of land in such districts ; and the exercise of such authority shall be deemed to be within the police power of the State. 29 CHAPTER 3 AMENDMENT TO CONSTITUTION AN ACT PROPOSING AN AMENDMENT TO ARTICLE III OF THE CONSTITUTION OF THE STATE OF DELA-WARE, RELATING TO THE TERMS OF OFFICE OF SHERIFFS AND CORONERS. These officers shall be chosen by the qualified electors of the re-spective counties at general elections, and be commissioned by the Governor." 30 CHAPTER 4 AMENDMENT TO CONSTITUTION AN 'ACT PROPOSING AN AMENDMENT TO ARTICLE V OF THE CONSTITUTION OF THE STATE OF DELAWARE RELATING TO ELECTIONS. That Article V of the Constitution of the State of Delaware be amended by adding immediately after Section 4A thereof a new section to be styled Section 4B as follows: Section 4B. The General Assembly shall enact uniform laws for the registration of voters of this State entitled to vote under this Article who are temporarily absent therefrom and in the Armed Forces or Merchant Marine of the United States, or retainers or persons accompanying or serving therewith, or who are absent from the State because of illness or injury received while serving in any such capacity, upon application in person or in writing. Jurisdiction and Property of the State CHAPTER 5 EXEMPTING CERTAIN IMPROVEMENTS ON PUBLIC LANDS FROM TAXATION AN ACT TO AMEND ARTICLE 1, CHAPTER 44, REVISED CODE OF DELAWARE, 1935, AS AMENDED, RELATING TO VALUATION AND ASSESSMENT OF PROPERTY BY EXEMPTING CERTAIN IMPROVEMENTS ON PUBLIC LANDS OF THE STATE OF DELAWARE. Be it enacted by the Senate and House of Representative's of the State of Delaware in General Assembly met: Section 1, That 1258. Sec. 1. of Article 1, Chapter 44, Re-vised Code of Delaware, 1935, as amended, be and the same is hereby further amended by adding a new paragraph at the end of said section, as follows : All public lands belonging to the State of Delaware and lo-cated in Sussex County which by Legislative enactment are held in trust by any municipal corporation of said State, and by it leased for an annual cash rental to any individual, association, corporation or partnership for manufacturing purposes, shall, together with any improvements thereon, be exempt from taxa-tion by said Municipal Corporation. Approved April 6, 1945. 31 32 CHAPTER 6 CESSION OF SUSSEX COUNTY AIRPORT TO UNITED STATES AN ACT AUTHORIZING THE LEVY COURT OF SUSSEX COUNTY TO CONVEY TO THE UNITED STATES OF AMERICA OR ANY INSTRUMENTALITY THEREOF, THE TITLE TO CERTAIN LANDS OF THE AIRPORT AND LANDING FIELD OF SUSSEX COUNTY AND RATIFYING AN OPTION GRANTED TO THE UNITED STATES OF AMERICA. WHEREAS, the Levy Court of Sussex County has acquired the absolute title in certain tracts, pieces or parcels of land in Georgetown Hundred, Sussex County and State of Delaware, about one mile southeast of the Town of Georgetown, Delaware, said title being in the name of the STATE OF DELAWARE, for the use of Sussex County, for the purpose of constructing an Airport and Landing Field in Sussex County; and WHEREAS, the Levy Court of Sussex County has hereto-fore entered into agreements, whereby the STATE OF DELA-WARE, for the use of Sussex County, has acquired the perpetual right and privilege of cutting and felling such trees and brush now standing upon certain other lands adjacent to the above lands which constitute a menace or hazard to the use of the said Airport and Landing Field ; and WHEREAS, the Levy Court of Sussex County entered into negotiations and agreements with the Civil Aeronautics Admin-istration to construct runways and other improvements on said lands; and WHEREAS, the Civil Aeronautics Administration has con-structed runways, drainage and other improvements on said Air-port and Landing Field ; and WHEREAS, THE UNITED STATES OF AMERICA has requested that the Levy Court of Sussex County lease the said Airport and Landing Field to THE UNITED STATES OF AMERICA for its use to train pilots for the United States Navy Air Force; and Chapter 6 33 CESSION OF SUSSEX COUNTY AIRPORT TO UNITED STATES WHEREAS, pursuant to the request of THE UNITED STATES OF AMERICA, the Levy Court of Sussex County has, on the Twenty-Sixth day of January, A. D. 1945, entered into an agreement with THE UNITED STATES OF AMERICA act-ing through its authorized agent, whereby the Levy Court of Sussex County did lease the said Airport and Landing Field to THE UNITED STATES OF AMERICA for its use to train pilots for the United States Navy Air Force; and WHEREAS, under the provisions of the Agreement of Lease, aforesaid, the Levy Court of Sussex County agreed to convey to THE UNITED STATES OF AMERICA on the request of THE UNITED STATES OF AMERICA all the right, title and interest which the State of Delaware, for the use of Sussex County, has or may hereafter acquire in and to all lands upon which permanent or temporary structures and improvements of any nature have been constructed out of Navy appropriations during the period ending six (6) months after the present states of war, provided that such lands do not lie within 250 feet of the center line of any runway ; and all lands upon which aprons, warm-up platforms or parking platforms constructed out of Navy appropriations are located, regardless of whether or not such lands lie within 250 feet of the center line of any runway, provided that such request of THE UNITED STATES OF AMERICA shall not include more than fifty percent (50%) of all areas suitable for airport buildings ; now, therefore, Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: Section 1. That the said Agreement to lease the Airport and Landing Field of the STATE OF DELAWARE, for the use of Sussex County, to THE UNITED STATES OF AMERICA for its use for training purposes for the United States Navy Air Force be and it is hereby ratified. Section 2. S., which stone is at the Southwest corner of the U. S. Containing 1,010.8 acres of land, more or less. Section 2. Be it further enacted, That exclusive jurisdic-tion over the aforesaid land is hereby ceded to the United States of America for any of the purposes described in said clause of the Constitution of the United States; provided, that the sover-eignty and jurisdiction of this State shall extend over the said land so far as that all civil or criminal process issued under authority of any law of this State may be executed in any part of the land; said jurisdiction to continue so long as the land shall be used for the purposes for which jurisdiction is ceded and no longer. Section 3. Be it further enacted, That this act shall take effect from and after its passage. Approved April 24, 1945. State Revenue and Supplies CHAPTER 8 INHERITANCE TAX AN ACT TO AMEND CHAPTER 6 OF THE REVISED CODE OF THE STATE OF DELAWARE OF 1935, AS AMENDED, RELATING TO INHERITANCE TAX. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: Section 1. That Section 101 of said Chapter 6 of the Re-vised Code of the State of Delaware 1935, being Code Section 135 of said Code be and the same is hereby amended by striking out and repealing the sixth paragraph of said Section 101, and substituting in lieu thereof the following: Any transfer of a material part of the property of a de-cedent in the nature of a final disposition or distribution thereof, made by the decedent within six months prior to his death, with-out full consideration in money or money's worth, shall, unless shown to the contrary, be deemed to have been made in contem-plation of death within the meaning of this Act. Section 2. That all acts or parts of acts inconsistent with this act are hereby repealed only to the extent of such incon-sistency. Approved April 11, 1945, 38 CHAPTER 9 INHERITANCE TAX AN ACT TO AMEND CHAPTER 6 OF THE REVISED CODE OF THE STATE OF DELAWARE OF 1935, AS AMEND-ED, RELATING TO INHERITANCE TAX. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: Section 1. That Section 101 of said Chapter 6 of the Re-vised Code of the State of Delaware 1935, being Code Section 135 of said Code be and the same is hereby amended by striking out and repealing the third paragraph of said Section 101, and substituting in lieu thereof the following: Whenever property, real or personal, is held in the joint names of two or more persons, or is deposited in banks or other institutions or depositories in the joint names of two or more persons and payable to either or the survivor, upon the death of one of such persons, the right of the surviving joint tenant or joint tenants, tenant by the entirety, or other such person or persons to the immediate ownership or possession and enjoy-ment of such property shall be deemed a transfer taxable under the provisions of this Act in the same manner as though the whole property to which such transfer relates belonged abso-lutely to the deceased joint tenant, joint depositor or tenant by the entirety and had been devised or bequeathed to the surviving joint tenant or joint tenants, tenant by the entirety, person or persons, by such deceased joint tenant, tenant by the entirety, or joint depositor by will, excepting therefrom such part thereof as may be proved by the personal representative of the decedent or by the surviving joint tenant or tenants or tenant by the entirety, or other such person or persons not to have been re-ceived or acquired from the decedent for less than adequate and full consideration in money or money's worth. Section 2. That Section 102 of said Chapter 6 of the Re-vised Code of the State of Delaware 1935, being Code Section 136 of said Code, as amended, be and the same is hereby further 39 40 Chapter 9 INHERITANCE TAX amended by striking out and repealing the first paragraph of Section 3 of Chapter 8, Volume 41, Laws of Delaware 1937, and substituting in lieu thereof the following: Where the property or any interest or estate therein passes to or for the use of (1) a brother, or sister, either of the whole or half blood of the decedent, or a lineal descendant of any such brother or sister of the whole or half blood of the decedent or (2) a brother or sister of decedent's parent or the child or children of any brother 'or sister of the decedent's parent, the tax shall be at the following rates : Section 3. That Section 104 of said Chapter 6 of the Re-vised Code of the State of Delaware 1935, being Code Section 138 of said Code, as amended, be and the same is hereby further amended by striking out and repealing Section 7 of Chapter 8, Volume 41, Laws of the State of Delaware 1937, and substituting in lieu thereof the following: Where any property, real, personal or mixed, which can be identified as having been received by the decedent or to which he or she is entitled as a share in the estate of any person who died within two years prior to the death of the decedent, or which can be identified as having been acquired by the decedent in exchange for property so received if an inheritance tax under this Article was collected from such estate, and if such property is included in decedent's gross estate, a deduction of an amount equal to the value of such property at the time of decedent's death shall be made. Section 4. That Section 104 of said Chapter 6 of the Re-vised Code of the State of Delaware 1935, being Code Section 138 of said Code, as amended, be and the same is hereby further amended by striking out the word "thirteen" in line two of para-graph 6 and adding in lieu thereof the word "fourteen". Section 5. That Section 105 of said Chapter 6 of the Re-vised Code of the State of Delaware 1935, being Code Section 139 of said Code, as amended, be and the same is hereby further Chapter 9 41 INHERITANCE TAX amended by striking out the word "fourteen" of the first sen-tence of Section 105, as amended by Section 8 of Chapter 8, Vol-ume 41, Laws of the State of Delaware 1937, and substituting in lieu thereof the word "fifteen". Section 6. That Section 105 of said Chapter 6 of the Re-vised Code of the State of Delaware 1935, being Code Section 139 of said Code, as amended, be and the same is hereby fur-ther amended by striking out and repealing Section 9 of Chap-ter 8, Volume 41, Laws of the State of Delaware 1937. Section 7. That Section 108A of said Chapter 6 of the Revised Code of the State of Delaware 1935, being Code Section 142A of said Code, as amended, be and the same is hereby fur-ther amended by striking out the word "twelve" on the second line of paragraph 3 of Section 1 of Chapter 4, Volume 44, Laws of the State of Delaware 1943, and substituting in lieu thereof the word "thirteen". Section 8. That all acts or parts of acts inconsistent with this act are hereby repealed only to the extent of such incon-sistency. Approved April 16, 1945. 42 CHAPTER 10 INCOME TAX AN ACT TO AMEND CHAPTER 6, OF THE REVISED CODE OF THE STATE OF DELAWARE, 1935, IN RELATION TO INCOME TAX. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: Section 1. That Section 110, of said Chapter 6, of the Re-vised Code of the State of Delaware, 1935, being Code Section 144 of said Code, as amended, be and the same is hereby further amended by striking out paragraph (1) under (b) of Section 110, and inserting in lieu thereof the following : (1) A natural person twenty-one years of age or over who is a resident of the State of Delaware or who has been a resident of the State of Delaware at any time during the income year. ("RESIDENT" DEFINED) The word "resident" applies only to natural persons and includes any person domiciled in the state, except a person who, though domiciled in the state, maintains no permanent place of abode within the state, but does maintain a permanent place of abode without the state, and who spends in the aggregate not to exceed thirty days of the taxable year within the state. In addi-tion, it includes any person who maintains a permanent place of abode within the state and spends in the aggregate more than seven months of the taxable year within the state, whether or not domiciled in the state during any portion of said period, and such a person shall be taxed the same as though he had been domiciled in the state during the entire taxable year. Section 2. That Section 110 (d) of Chapter 6, of the Re-vised Code of the State of Delaware, 1935, being Code Section 144 of said Code, be and the same is hereby further amended by striking out paragraph 9 and inserting in lieu thereof the fol-lowing new paragraph : a ec Chapter 10 43 INCOME TAX Less the aggregate of the exemptions provided for in Section 112, and of the deductions provided for in Section 113. Section 3. That Section 111, of said Chapter 6, of the Revised Code of the State of Delaware, 1935, being Code Section 145 of said Code, as amended, be and the same is hereby amended by striking out paragraph (h) of said Section 111, and substi-tuting in lieu thereof the following: (h) In the case of the death of a taxpayer there shall be included in computing net income for the'taxable period in which falls the date of his death, only amounts received or credited subject to withdrawal during such period, except, in the case of a taxpayer whose income is computed upon the basis of the accrual method of accounting, amounts (except amounts in-cludible in computing a partner's net income) accrued only by reason of the death of the taxpayer shall not be included in com-puting net income for the period in which falls the date of the taxpayer's death. (h) (1) All income accrued by reason of death only, as set forth in paragraph (h) of this Section shall constitute tax-able income of the estate when received by it or of a beneficiary when received by him and not previously included in the return of the estate. Section 4. That Section 112, of said Chapter 6, of the Revised Code of the State of Delaware, 1935, being Code Section 146 of said Code, as amended, be and the same is hereby amend-ed by adding a new paragraph to be known as 112 (a) (12). (12) Amounts received as a pension, annuity or similar allowance for personal injuries or sickness resulting from active service in the armed forces of the United States. Section 5. That Section 112, of said Chapter 6, of the Revised Code of the State of Delaware, 1935, being Code Section 146 of said Code, as amended, be and the same is hereby amend-ed by adding a new paragraph to be known as 112 (a) (13). 44 Chapter 10 INCOME TAX (13) Whenever the computation of any tax imposed by this act includes profits, gains, or income from a contract or contracts, with the United States or any department, agency or instrumentality thereof, or from any sub-contract, or sub-con-tracts thereunder, and after the filing of the return of payment of the tax, such profit, gain or income should be redetermined by renegotiating or repricing pursuant to the laws of the United States, upon the showing thereof, by the taxpayer by the filing of a claim within two years from the date the amount is finally determined, the tax for said taxable year shall be recomputed on the basis of redetermined profit, gain, or income, and credit or refund without interest allowed for any overpayment thereby appearing, without regard to whether the settlement in the re-negotiation or repricing proceedings was voluntary or involun-tary. Such recomputation, however, shall not be made nor shall credit or refund be allowed as herein provided unless and until satisfactory evidence has been presented to the State Tax De-partment that the sums due the United States by reason of such redetermination have been actually paid. The provisions of this paragraph shall apply to all income tax returns for the year 1942 and all subsequent years. Section 6. That Section 113, of said Chapter 6, of the Revised Code of the State of Delaware, 1935, being Code Section 147 of said Code, as amended, be and the same is hereby amend-ed by striking out paragraph (3) of said Section 113, and insert-ing in lieu thereof the following: (3) Taxes imposed upon and accrued or paid by the tax-able, including Delaware Liquor and Gasoline Taxes, within the income year, except taxes imposed by this act and taxes assessed for local benefits of a kind tending to increase the value of the property assessed. Section 7. That Section 113, of said Chapter 6, of the Revised Code of the State of Delaware, 1935, being Code Section 147 of said Code, as amended, be and the same is hereby amend-ed by adding the following new paragraph at the end of Section 113 (5). Chapter 10 45 INCOME TAX (5a) Contributions to organizations falling within the above paragraph, but which are located outside the State of Delaware, but only if such contributions are for use in Delaware or for the use or benefit of residents of Delaware. Section 8. That Section 113, of said Chapter 6, of the Revised Code of the State of Delaware, 1935, being Code Section 147 of said Code, as amended, be and the same is hereby amend-ed by striking out paragraph (14) of said Section 113, and sub-stituting in lieu thereof the following: (14) In the case of the death of the taxpayer there shall be allowed as deductions or credits for the taxable period, in which falls the date of his death, only amounts actually paid during such period, except, in the case of the taxpayer whose income is computed upon the basis of the accrual method of accounting, amounts (except amounts includible in computing a partner's net income) accrued only by reason of the death of the taxpayer shall not be allowed as deductions or credits for the period in which falls the date of the taxpayer's death. (14a) All deductions accrued by reason of death only, as set forth in paragraph 14 of this Section, shall be allowable to the estate when paid by it, or to a beneficiary if paid by him and not previously allowed in the return of the estate. Section 9. That Section 121, of said Chapter 6, of the Revised Code of the State of Delaware, 1935, being Code Section 155 of said Code, as amended, be and the same is hereby amend-ed by striking out paragraph (j) of Section 121, and substituting in lieu thereof the following: (j) Submit to the Governor and to the Legislature an an-nual report covering the fiscal year ending June 30, including such recommendations concerning State taxes as may be deemed necessary. Section 10. That Section 124 (a) (1), of said Chapter 6, of the Revised Code of the State of Delaware, 1935, being Code. 46 Chapter 10 INCOME TAX Section 158 of said Code, as amended, be and the same is hereby amended by striking out paragraph (1) under (a) of Section 124, and substituting in lieu thereof the following: (1) The full amount of the tax payable as the same shall appear on the face of the return, shall be paid to the Tax De-partment where the return is filed at the time fixed by law for filing return, but if the amount of tax payable is more than five dollars, the said tax may be paid in four equal installments, as follows : Section 11. That Section 125, of said Chapter 6, of the Revised Code of the State of Delaware, 1935, being Code Section 159 of said Code as amended, be and the same is hereby .amend-ed by striking out paragraph (b) in said Section 125, and sub-stituting in lieu thereof the following : (b) If the Tax Department discovers from the examina-tion of the return or otherwise that tax on the income of any taxable, or any portion thereof, has not been assessed, it may, at any time within two years after the time when the return was due, or if not filed on the due date within two years from the date the return was filed, assess the tax on the same and give notice to the taxable of such assessment and at the termination of thirty days, the additional tax determined by the Tax Depart-ment shall be due and payable unless the taxable or his agent or attorney shall have within said thirty days, filed complaint or appeal in writing over his signature from the assessment of the Tax Commissioner and request a hearing before the State Tax Board as provided in Section 120 (c) of this Article. The limita-tion of two years to the assessment of such tax shall not apply to the assessment of additional taxes upon returns which are fraud-ulent or the income thereon grossly understated or in cases where no return has been filed. Section 12. That all acts or parts of acts inconsistent with this act are hereby repealed only to the extent of such incon-sistency. Sec. 159 of Chapter 14, Volume 41, Laws of Delaware, 1937, as amended, be and the same is hereby further amended by striking out the eleventh paragraph of said Section 3. 193. Sec. 159 relating to Employ-ment Agent, Ten Dollars ($10.00), and substituting in lieu thereof the following: Employment Agent, Ten Dollars ($10.00). Employment Agent shall include every person engaged, for profit, in the busi-ness of hiring laborers or securing positions for other persons to be employed within the limits of the State of Delaware. Sec. 159 of Chapter 14, Volume 41, Laws of Delaware, 1937, as amended, be and the same is hereby further amended by adding thereto a new para-graph as follows : Emigrant Agent, Two Hundred Fifty Dollars ($250.00). Emigrant Agent shall include every person engaged in hiring laborers or soliciting emigrants in this State to be employed be-yond the limits of this State; provided, however, that no con-tractor resident in the State of Delaware shall be liable for license as an Emigrant Agent by reason of his employing labor for his own work on contracts to be performed outside the State of Delaware. Sec. 161 thereof and substituting in lieu thereof the follow-ing: Circus Exhibitor, Five Hundred Dollars ($500.00) for use within the corporate limits of any City in this State having a population of over 50,000 people; Three Hundred Dollars ($300.00) for use within one mile of the corporate limits of any City in this State having a population of over 50,000 peo-ple; One Hundred Dollars ($100.00) for use not within one mile of the corporate limits of any City in this State having a population of over 50,000 people. Circus Exhibitor shall include every person engaged. in the business of exhibiting in a tent, arena, or other open space feats of horsemanship, acrobatic stunts, freaks, trained or wild animals, and other forms of enter-tainment commonly known as circus, including the conducting of eating houses and merchandising inside the tents of said Circus Exhibitor ; provided, however, that this paragraph shall not be construed to include any circus or carnival for private profit sponsored by or in which any Fire Company of the State, or any fraternal, veteran's or religious organization, shall share in the profits ; the license fee for such circus or carnival shall be One Hundred Dollars ($100.00). Coin Operated Amusement Machine Owner shall in-clude every person engaged in the business of owning and oper-ating on his own account or by his agent, or leasing to or placing with another on a commission or other basis any coin operated machine, device or table upon or by means of which games are played by the general public for amusement and entertainment, but not for money or other thing of value, and shall pay, in addi-tion to the license fee required for engaging in such business, a fee for license for each coin operated amusement machine so owned and operated according to the following rates : All ma-chines having a device in which a penny is required or may be used to operate the machine, Five Dollars ($5.00) ; all machines having a device in which a nickel or coin of larger denomination is required or may be used to operate the machine, Ten Dollars ($10.00). Section 2. That Chapter 6 of the Revised Code of Dela-ware, 1935, as amended by Chapter 67, Volume 42, Laws of Dela-ware, be and the same is hereby further amended by striking out all of paragraph (c) in Section 1 of said Chapter 67, Volume 42, Laws of Delaware, and inserting in lieu thereof a new paragraph to be known as paragraph (c), as follows : 49 50 Chapter 13 OCCUPATIONAL LICENSES RELATING TO COIN OPERATED MUSICAL MACHINES (c) Music Machine Owner embracing every person engag-ed in the business of owning and operating either on his own account or by his agent, or by lease to another from such person or his agent, certain mechanical devices hereinbefore referred to for furnishing to the public, music by the playing of records or transcriptions and shall pay a fee for a license at the rate of Ten Dollars ($10.00) for each machine so owned and operated. Approved May 9, 1945. 53 54 CHAPTER 17 CIGARETTE TAX PROVIDING FOR REFUNDS TO DEALERS OF TAX ON CERTAIN SALES AN ACT TO AMEND CHAPTER 9, VOLUME 44, LAWS OF DELAWARE (1943) KNOWN AS THE CIGARETTE TAX ACT BY PROVIDING FOR REFUNDS IN CASH OF TAX PAID BY DEALERS ON CIGARETTES SOLD AND SHIP-PED INTO ANOTHER STATE, SOLD TO COMMISSARIES, SHIPS' STORES AND VOLUNTARY UNINCORPORATED ORGANIZATIONS OF THE ARMY OR OF THE NAVY PERSONNEL, ON UNSALEABLE OR DESTROYED CIG-ARETTES AND ON CIGARETTES ON HAND AFTER MAY 31, 1945, THE EXPIRATION DATE OF THE CIGA-RETTE TAX ACT. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: Section 1. That Chapter 9, Volume 44, Laws of Delaware (1943) be and the same is hereby amended by striking out the first paragraph of Section 10 and inserting in lieu thereof the following: Whenever any cigarettes, upon which stamps have been placed by a dealer, have been sold and shipped by him into an-other state for sale or use therein, or have been sold to commis-saries, ships' stores and voluntary unincorporated organizations of the Army or of the Navy personnel operating under regula-tions promulgated by the Secretary of War or the Secretary of Navy for resale to authorized purchasers, or have become unfit for use and consumption or unsaleable or have been destroyed, such dealer shall be entitled to a refund on the actual amount of tax paid by him with respect to such cigarettes. Any dealer who has on hand after May 31, 1945, the expiration date of the Cigarette Tax Act, cigarettes upon which stamps have been placed shall be entitled to a refund of tax paid with respect to such cigarettes, provided that application for refund is made not later than November 30, 1945. If the department is satisfied that any dealer is entitled to a refund, such refund shall be Chapter 17 55 CIGARETTE TAX PROVIDING FOR REFUNDS TO DEALERS OF TAX ON CERTAIN SALES made by the State Treasurer on certification by the department with the approval of the State Tax Board. The State Treasurer is hereby authorized and directed to pay out of any funds not otherwise appropriated the amounts certified for refund in ac-cordance with this Act. The department is hereby authorized to adopt, prescribe, and promulgate such rules and regulations with regard to the presentation and proof of claim for refunds, as it may deem advisable. Section 2. All acts or parts of acts inconsistent with this Act are hereby repealed to the extent of such inconsistency only. PLEASANT DISTRICT NO. 2, NEW CASTLE COUNTY AN ACT RE-ALLOCATING THE BALANCE OF FUNDS IN THE SCHOOL BUILDING ACCOUNT FOR MT. PLEAS-ANT DISTRICT 1;2, NEW CASTLE COUNTY, FOR USE AND AID IN THE REVISED BUILDING PROGRAM FOR SAID SCHOOL D/STR/CT, AND AUTHORIZING A REF-ERENDUM AS TO THE EXPENDITURE OF SAID FUNDS PURSUANT TO SAID PROGRAM. WHEREAS, by Chapter 79 of Volume 43, Laws of Dela-ware, 1941, the Senate and House of Representatives of the State of Delaware, in General Assembly met, appropriated the sum of Seven Hundred Fifty Thousand Dollars ($750,000.00) to the State Board of Education for use and aid in a school building program, and provided that the State Board of Education allo-cate to Mt. Pleasant School District 12, New Castle County, any amount not in excess of One Hundred Thousand Dollars ($100,000.00) on condition that said district contribute Fifty Thousand Dollars ($50,000.00) ; WHEREAS said school district, by proceeds of a bond issue authorized by a referendum pursuant to law, contributed the sum of One Hundred Six Thousand, Eight Hundred Twenty-three Dollars and Sixty-one cents ($106,823.61), and the State Board of Education allocated to said school district, pursuant to Chapter 79 of Volume 43, Laws of Delaware, 1941, the sum of Seventy-two Thousand Five Hundred Ninety-two Dollars ($72,592.00) ; WHEREAS said funds were appropriated and allocated for use and aid in a building program submitted by the State Board of Education and approved by the Board of Trustees of said school district, said program contemplating an addition of twelve classrooms and necessary additional auxiliary rooms; WHEREAS, due to the war emergency, there has been con-structed in said school district, with the use of Federal funds and the funds contributed by said school district and allocated Chapter 20 59 RE-ALLOCATING BALANCE OF FUNDS IN SCHOOL BUILDING ACCOUNT OF MT. PLEASANT DISTRICT NO. 2, NEW CASTLE COUNTY by the State Board of Education, an addition of only eight class-rooms, and with the completion of the work of enlarging the cafeteria, the Building Commission for said district will have no further work which can be done in connection with said build-ing program under the authority of existing statutes; WHEREAS, it is estimated that with the completion of the present work, there will be a balance in the School Building Account for said school district, in the Farmers Bank of the State of Delaware, of approximately One Hundred Thousand Dollars ($100,000.00) WHEREAS, the rapid growth of the school population in said school district with grossly inadequate school facilities has created a dangerous condition and constitutes an emergency requiring the construction of additional school facilities as early as conditions will permit ; WHEREAS, to meet the needs of said school district, there has been adopted by the Board of School Trustees of Mt. Pleasant District »2, New Castle County, and by the State Board of Edu-cation, a revised tentative building program for said school district ; WHEREAS, said revised tentative building program con-templates the construction in the Southern section of said dis-trict, of a school building, and the construction in the Northern section of said district, of a school building, both buildings con-sisting of necessary classrooms and additional auxiliary rooms, the equipping thereof and the acquisition of land in said district upon which to construct said buildings, therefore Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: Section 1. The Board of School Trustees of Mt. Pleasant District »2, New Castle County, shall hold a special election at the schoolhouse in said district, advertising and giving notice of same in the manner provided in Chapter 71, Article 11, 2725, Section 103, of the Revised Code of Delaware, 1935. All of said 60 Chapter 20 RE-ALLOCATING BALANCE OF FUNDS IN SCHOOL BUILDING ACCOUNT OF MT. PLEASANT DISTRICT NO. 2, NEW CASTLE COUNTY advertisements and notices shall contain a clear statement as to the approximate amount of funds remaining in the School Building Account for said district, the completion of the building program at the present school house site in said district, and that the purpose of the election is to vote for or against the use of said funds in connection with the tentative revised building program for the acquisition of land sites and the construction and equipping of school buildings in other portions of the dis-trict. The vote at said election shall be by ballot, on which shall be written or printed : "For use of remaining funds in tentative revised building program for Mt. Pleasant District", or, "Against use of remaining funds in tentative revised building program for Mt. Pleasant District." The polls for said election shall be open at one o'clock P. M. of the day advertised for said election ac-cording to said advertisements and remain open until six o'clock P. M. of said day, and said election shall be held by such persons as shall be designated by the Board of said district. At such election every person possessing the qualifications provided in Chapter 71, Article 17, 2753. Section 131, of the Revised Code of Delaware, 1935, shall be entitled to vote. Section 2. The money remaining in the School Building Account for Mt. Pleasant School District #2, New Castle County, in the Farmers Bank of the State of Delaware, is hereby re-al-located for use and aid in the revised building program of Mt. Pleasant School District #2, New Castle County, as the same shall be finally approved by the Board of School Trustees of said School district. Upon the approval of a majority of the voters of said district at the election provided for in Section 1 of this Act, said funds or any part thereof may be expended in said district for the taking of options to buy and for acquisition by gift, pur-chase, condemnation or otherwise of land sites in the Southern section or in the Northern section of said district, or both, for the construction, furnishing and equipping of new school build-ings On said sites, and the grading and equipping of school grounds on said sites, pursuant to said tentative revised building program, as the same shall be finally approved by the Board of said district. Chapter 20 61 RE-ALLOCATING BALANCE OF FUNDS IN SCHOOL BUILDING ACCOUNT OF MT. PLEASANT DISTRICT NO. 2, NEW CASTLE COUNTY Section 3. The administering of said program, as finally adopted, shall be under the control and supervision of a building commission for said district, and insofar as the provisions of Chapter 206 of Volume 36, Laws of Delaware, 1929, are not in .conflict with this Act, said provisions of Chapter 206 shall be given full force and effect. Said building commission shall be constituted as provided in Chapter 206 of Volume 36, Laws of Delaware, 1929, as amended by Section 8 of Chapter 79, Volume 43, Laws of Delaware, 1941. Said building commission shall have full authority and discretion to determine the order in which the various parts of said tentative revised building pro-gram shall be performed. Section 4. The funds hereby re-allocated may be used and .expended with any funds which may be received by grant or gift from the State of Delaware, the Federal Government or any agency, bureau, commission or department thereof, or from any other source whatever. Section 5. This Act shall apply and be equally effective, whether said district remains a State Board District or becomes a Special School District. In the event said district becomes a Special School District before the election provided for in Section 1 of this Act has been conducted, the said election shall be in charge of the Board of Education of said Special District, and the power to change and finally approve said tentative revised building program shall be in said Board of Education. Section 6. All acts or parts of acts inconsistent with the provisions of this Act are hereby repealed to the extent of such inconsistency. Be it enacted by the Senate and House of Representatives of the State of Delaware in General Assembly met: Section 1. That the third paragraph of 411. Sec. 14 of Chapter 15 of the Revised Code of Delaware, 1935, be and the same is hereby amended to read as follows : The said Commissioner shall apply all monies and valuable securities which may be credited to the Sinking Fund aforesaid towards the extinguishment of the Public Funded Debt of the State, and he is empowered and required, as speedily as possible, to invest all monies to the credit of the Sinking Fund aforesaid by the purchase of good State, County, Municipal and United States Government Bonds, preferring the bonds of this State, bonds of the Counties of the State, Municipal bonds of this State and United States Government bonds and may from time to time sell, assign and reinvest for the benefit of said Sinking Fund, and he shall reinvest the interest received on account of securities so purchased by said Commissioner ; provided, that no money shall be invested by said Commissioner without the written consent and approval of the Governor, Secretary of State and Audifor of Accounts, or a majority of them, nor shall any securities be as-signed or otherwise disposed of without such written consent and approval.
